COMPETITION TERMS & CONDITIONS OF ENTRY
1.
Information on how to enter, mechanics of entry and Prizes form part of these Conditions of Entry. Entry into the Promotion is deemed acceptance of these Conditions of Entry.
2.
Entry is open to residents of Australia aged 18 years old and above (Entrants). Employees (and their immediate families) of the Promoter and agencies associated with this Promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child, or stepchild (whether natural or by adoption), parent, stepparent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, stepbrother, stepsister, or first cousin.
3.
The Promoter is CARBA-TEC PTY. LTD. (ABN: 84 010 706 242) of 128 Ingleston Road, Wakerley 4154, QLD, Australia.
4.
The Promotion commences at 2.00 pm (AEST) on Thursday, 10 August 2023 and ends at 11.59 pm (AEST) on Sunday, 3 September 2023 (“Promotional Period”).
5.
To enter, Entrants must purchase a qualifying Laguna machine and confirm or submit a valid email address and phone number through carbatec.com.au or through a Carbatec retail location.
6.
The qualifying machines are limited to stock availability and are to be purchased within the selection of the following 19 machines.

By entering, Entrants must also agree to the competition Terms and Conditions.
8.
Once an Entrant has submitted their completed entry, they will be treated as having submitted one (1) entry into the Promotion. One entry per eligible email address will be permitted.
9.
Entries will be deemed accepted at the time of receipt by the Promoter and not at the time of transmission. Entries received will be considered final by the Promoter. Incomplete, inaccurate, erroneous, ineligible, or incomprehensible entries will be deemed invalid. The Promoter accepts no responsibility for late, lost, or misdirected entries.
10.
The Draw from all eligible entries will be conducted at 2.00 pm (AEST) Monday, 4 September 2023, 128 Ingleston Road, Wakerley 4154, QLD, Australia. Upon verification by the Promoter, the Winners of the Promotion are the first four (4) individual, eligible entries drawn. The individual Winners of one (1) machine per participant will be notified in writing by email and/or phone immediately after the Draw and will be announced on Carbatec social media Friday, 8 September 2023. The four (4) Prizes will be awarded as follows.

If Prize is unclaimed or forfeited by 5:00 pm (AEST) on Friday, 08 September 2023, a second chance draw will occur at the same place and time as the original Draw on Friday, 08 September 2023. The Winner, if any, will be notified by email and/or phone on Monday, 11 September 2023 and will be announced on Carbatec social media channels Friday, 15 September 2023, for a minimum of 28 days.
13.
The Prizes are not transferable or exchangeable and cannot be taken as cash. The Prizes must be taken as offered and cannot be varied. If, for any reason, a winner is unable to accept the Prize as stated, the Winner will forfeit the Prize, and no compensation will be given in lieu. The Promoter accepts no responsibility for any tax implications arising from the Prize winnings. The Prize value is accurate as of Tuesday, 08 August 2023, and the Promoter is not responsible for any value variation. Prize values are in Australian dollars, and recommended retail price includes GST where applicable. Prize supplier conditions apply.
14.
Winners do not have to choose a prize of equal or lesser value than the eligible Laguna product they have purchased. The winner may choose any Laguna item from the approved list as their prize. Any Laguna products sold at Carbatec at reduced prices and on the eligible list qualify for entry to the contest.
15.
Men’s shed organisations may not purchase Laguna products at their organisation discount for an entry into the contest. Men’s shed members may purchase eligible Laguna products in-store, individually at full price and be entered into the draw.
16.
The Winner must be a minimum of 18 years of age at the time of receipt. Prize Terms and Conditions apply. The Prizes are subject to availability.
17.
If any portion of a Prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the Prize, or that element of the Prize, for a Prize of similar theme and of equal value, subject to State regulation and subsequent approval.
18.
The winner is responsible for ensuring that the prize selected is suitable for their intended use and that the chosen location has the electrical capacity required for the connection of the selected machine. The winner is responsible for assessing any safety requirements or technical specifications associated with the chosen prize. Once an individual prize is chosen by each winner and awarded, it may not be returned, exchanged, or refunded.
19.
The competition is open to Australian residents only. The collection of prizes will be available from any of the six Carbatec store locations within Australia. Locations include Brisbane, Melbourne, Sydney, Perth, Adelaide, and Hobart. Direct shipping to the Winner’s physical address within the Australian mainland and Tasmania is available if the closest Carbatec store location is over 50 kilometres from Winner’s physical location. Any government directives and/or restrictions based on Covid, or other health measures must be followed by Carbatec and the Winner during the delivery or pickup process.
20.
The Promoter does not exclude any rights and remedies in respect of goods or services under the Australian Consumer Law in the Competition and Consumer Act (2010) (Australian Consumer Law), which cannot be excluded, restricted, or modified. However, the remainder of this clause will apply to the fullest extent permitted by law. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the Entrant or for any of the equipment or programming associated with or utilised in this Promotion, or for any technical error or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
21.
Entrants can only enter their own name. Entrants who provide incorrect, misleading, or fraudulent information are ineligible to participate in the Promotion, and all entries of an Entrant who is deemed by the Promoter to have provided false, misleading or fraudulent information may, at the discretion of the Promoter, be deemed invalid. The Promoter reserves the right to request the Entrant produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) to confirm the Entrant’s identity, age, residential address, eligibility to enter and claim a Prize, and any information submitted by the Entrant in entering the Promotion, before issuing a Prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or an Entrant or entry has not been verified or validated to the Promoter’s satisfaction, then all the entries of that Entrant will be ineligible and deemed invalid.
22.
It is a condition of accepting a Prize that the Winner may be required to sign a legal release in a form determined by the Promoter at its absolute discretion.
23.
The Prizes will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.
24.
The use of any automated entry software or any mechanical, electronic, or other means that allows an Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Entrant invalid.
25.
The Promoter and its associated agencies and companies are not liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person’s negligence) in connection with taking any Prize or using any Prize, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
26.
The Promoter and its associated agencies and companies are not responsible for any problems, delays or technical malfunction of any telephone or network or lines, servers or providers, fax equipment, computer equipment, software, technical problems or traffic congestion on a network or a mobile network or any combination thereof, or any other technical failures including any damage to Entrants or any other person's fax equipment, mobile handset, computer or peripherals related to, or resulting from, participation in this Promotion or the downloading of any materials associated with this Promotion.
27.
The Promoter will not be responsible for any incorrect, inaccurate, or incomplete information communicated in the course of, or in connection with, this Promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter, including but without limitation technical malfunctions or failures.
28.
If, for any reason, this Promotion is not capable of running as planned for any reason beyond the reasonable control of the Promoter, including because of war, terrorism, state of emergency or disaster (including natural disaster), infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Promotion and/or if necessary to provide an alternative prize or prizes to the same value as the original Prize, subject to any applicable laws or written directions made under applicable legislation.
29.
The Promoter reserves the right to verify the validity of any and all entries and reserves the right to disqualify any Entrant for:
(a) tampering with the entry process;
(b) submitting an entry that is not in accordance with these Conditions of Entry, or
(c) if the Entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion.
The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
30.
As a condition of entering this Promotion, an Entrant consents to, in the event they are a winner, the Promoter using the Entrant’s image and caption, name, likeness, image, voice (including photograph, film and/or recording of the same), and/or entry in any media for an unlimited period of time and worldwide without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing the Promotion (including any outcome), and/or promoting any products or services manufactured, distributed and/or supplied by the Promoter and their associated or affiliated companies. The Entrant agrees that, if they are a winner, the Entrant will participate in all reasonable promoted activities related to the Promotion as requested by the Promoter and its agents.
31.
An entry and any copyright subsisting in an entry irrevocably becomes, at the time of entry, the property of the Promoter and may be used by the Promoter at any time. The Promoter collects personal information about an Entrant to include the Entrant in the Promotion and, where appropriate, award Prizes. If the personal information requested is not provided, the Entrant cannot participate in the Promotion and is deemed ineligible. An Entrant can gain access to, update or correct any personal information held by the Promoter by contacting the Promoter’s Privacy Officer at the address in condition 3 of these Terms & Conditions. All personal information will be stored at the office of the Promoter. A copy of the Promoter’s Privacy Policy in relation to the treatment of personal information collected may be obtained by contacting the Promoter.
32.
By participating in this Promotion, Entrants consent to the storage of their entry information on the databases of the Promoter. In addition, Entrants agree to the Promoter using their entrant details for the purpose of sending information on offers and promotions by mail, phone/SMS/MMS and/or email for an indefinite period or until such time that an Entrant notifies the Promoter or opts out from receiving these communications.
33.
Further information as to; how the Promoter handles Entrant information; how entrants can complain about any breach of the Australian Privacy Principles; how the Promoter will deal with a complaint of that nature, and how entrants can access or seek correction of any data collected in a Promotion will be handled in accordance with the Promoter’s Privacy Statement, a copy of which is available by contacting the Promoter.
